A Guide to Parenting Plan Assessments in Los Angeles Superior Court: What to Expect and How M.C. Law Can Help

When dealing with family court matters in Los Angeles, you may encounter a "Parenting Plan Assessment" (PPA2), a thorough evaluation aimed at determining the most suitable custody arrangement for your child. This process involves in-depth interviews and observations to help the court make informed decisions. Here’s what you need to know about the PPA2 and how M.C. Law, P.C. can support you through it.

What is a Parenting Plan Assessment (PPA2)?

A PPA2 is a two-day assessment ordered by the court when additional information and clinical judgment are required to determine the best custody arrangement for your child. The process includes interviews and observations to assess how different parenting plans might affect your child's well-being.

The Process: What to Expect

    1. Interviews and Observations:

  • Interviews: The FCS Specialist will interview both parents and any children aged 8 or older. These interviews may take place via videoconference (using WebEx) or in person. The specialist will contact you in advance to arrange these sessions and provide necessary video links.
  • Family Observation: If health conditions permit, both parents and children will be asked to attend the FCS office for interviews and a family observation. This will involve observing interactions between each parent and the child(ren).

    2. Pre-Hearing Meetings:

  • Before the final hearing, the FCS Specialist will review their recommendations for custody and visitation with the parties. This meeting can be via videoconference, telephone, or in person, and legal counsel for represented parties will be invited. The hearing, typically scheduled at 1:30 p.m., will include testimony from the FCS Specialist, who will present their findings and recommendations subject to cross-examination.

Fees and Payments

  • Fee Payment: Unless waived by the court, the fee ($975.00 per person) for the PPA2 must be paid to the Family Law Clerk’s Office at any courthouse with an FCS office. Payment is due within 21 calendar days (watch out because some departments order a 14 day deadline!) from the order date. The fee per Late payment will result in the cancellation of the assessment.

  • Refunds: If your case settles before the assessment begins, you may receive a full refund by notifying the FCS office in advance. Otherwise, a $53 administrative fee will apply.

Documents and Preparation

  • Written Materials: You need to provide copies of any relevant documents, such as letters from therapists or school records, to both the other parent and the FCS Specialist via email. These documents help the specialist form a complete picture of your situation.

  • Collateral Contacts: Provide names and contact details of individuals with relevant information about the custody issue. Keep in mind that due to time limitations, not all suggested contacts or documents may be reviewed.

The Interview Process

  • Preparation: During interviews, you’ll need to speak with the FCS Specialist without your children present. Arrange for childcare if necessary, and be prepared by downloading the WebEx app for any scheduled videoconferences.

  • Honesty is Key: Be transparent during your interviews. If you have trouble understanding questions or feel misunderstood, communicate your concerns clearly.

Safety Concerns

  • Reporting: If there are any signs of violence or abuse, the FCS Specialist is legally and ethically obligated to report these concerns, including verbal, physical, emotional, or technology-enabled abuse.
